Treasury Proposes Rule Barring Large Institutional Investors From Buying Single-Family Homes
Proposed rule implements Section 1001 of the 21st Century ROAD to Housing Act
The Department of the Treasury has issued a proposed rule to implement Section 1001 of the 21st Century ROAD to Housing Act (the ROAD Act), which prohibits large institutional investors from purchasing single-family homes, subject to certain statutory exceptions. The proposed rule seeks to clarify terms relevant to the restriction, including the definition of "large institutional investor," and to explain how specific exceptions to the prohibition would apply.
Treasury's proposal also addresses the statutory enforcement mechanism tied to the prohibition. According to the agency, the rule is intended to give market participants and other stakeholders clarity on how the statute will be applied before the ROAD Act's effective date.
While the rule centers on housing market policy rather than procurement, federal contractors and firms with real estate, housing finance, or institutional investment portfolios should monitor the rulemaking closely, as it could affect acquisition strategies, compliance obligations, and market entry for large investors operating in the single-family housing sector. The proposed rule was published as a Proposed Rule by the Treasury Department.
